ARTICLE I. General.
Section 1. Operation of the Property.
The operation of the Property of
the Condominium shall be governed by these By-Laws.
The term "Property" means and includes the land, the Buildings and all
other improvements thereon, and all easements, rights and appurtenances
belonging thereto, excepting all of the unused air development and zoning rights
available to the Sponsor, or its Transferee, under the Zoning Resolution of the
City of New York (the "Air Rights") and such other rights as have been conferred
by the Sponsor, or its Transferee, pursuant to the section of the Offering Plan
entitled "Air Rights", and all of the fixtures and articles of personal property
attached or appurtenant to or used in connection therewith, which have been
submitted to the provisions of the Condominium Act. Unless otherwise defined,
all capitalized terms have the meaning defined in the Condominium Offering
Plan for Regent's Park Condominium, as amended.
The Declaration, the By-Laws and the Rules and Regulations attached
hereto, each as amended from time to time, shall be applicable to, and binding
upon, each Unit Owner, all mortgagees, lessees and occupants of Units and their
employees and all other persons who may use the facilities of the Property in
any manner.
Section 2. Amendment of Rules and Regulations. The Rules and Regulations may be amended from time to time by the Board provided that a copy of such amendment is furnished to each Unit Owner not less than five (5) days prior to the time that it becomes effective. Any provision of the Rules and Regulations may be modified or rescinded by vote of sixty-six and two-thirds percent (66-2/3%) of the Unit Owners at a meeting duly called for such purpose.
Section 3. Office. The Office of the Condominium and of the Board shall be located at the Property or the office of the Managing Agent.
